Terms of Business.

These Terms of Business outline the basis on which Teach Global provides teacher recruitment and placement services to early childhood centres, schools, and education providers.

Our goal is to connect you with qualified, vetted New Zealand teachers who meet your specific staffing needs — whether for permanent, fixed-term, or long-term relief positions. These terms define the responsibilities of both parties, the structure of our fees, our replacement guarantee (where applicable), and the process we follow from referral to placement.

By engaging our services or reviewing candidate profiles submitted by us, you are deemed to have accepted these Terms of Business. We recommend you read them carefully and get in touch if you have any questions or would like to discuss adjustments to suit your school or centre’s specific requirements.

We look forward to supporting your team with quality teachers and a smooth, professional hiring process.

"Client" refers to any business, organisation, or individual to whom the Agency provides candidates.

"Candidate" refers to any person introduced by the Agency to the Client for permanent employment or engagement.

"Engagement" refers to the employment, hire, or use of a Candidate by the Client (or related entity) on a permanent, part-time, or other basis.

"Introduction" means the provision of any information by the Agency which identifies a Candidate.

2. Acceptance of Terms

These Terms are deemed accepted by the Client upon:

  • Watching a candidate video introduced by the Agency, or

  • Interviewing a Candidate introduced by the Agency, or

  • Engaging a Candidate, or

  • Requesting an introduction of Candidates.

3. Fees

If a client offers a contract to a candidate and the candidate accepts the job offer, a placement fee is due.

All placement fees are calculated based on a Full-Time position equivalent. Minimum fee of $7000 AUD

A placement fee of 12% - 15% the Candidate's total first-year base salary (excluding bonuses or benefits) is payable for all permanent placements.

Fixed fees can be arranged with clients, and fee variations can be on a case-by-case basis. Please consult with the Teach Global Manager.

The fee becomes due and payable within 14 days upon invoice, and/or before the candidate starts at the school or centre - whichever is sooner.

4. Terms

Teach Global works with clients to take a job brief with a detailed job description provided by the client. Teach Global will then source and present suitable candidates for interview.

Exclusive Agreement:  Job vacancies must be placed exclusively with Teach Global for a minimum of 3 months before engaging other agencies. If the Client engages other agencies at any time prior to 3 months, the fee due upon placement will reflect the Non-exclusive fees.

Under an Exclusive agreement, Teach Global covers the costs for advertising. If the role moves from Exclusive to Non-exclusive agreement, the Client will be billed for advertising costs incurred.

Non-exclusive agreement: The Client may choose to engage other agencies. The Client agrees to keep Teach Global updated with the status of the role, and any other candidates they’re interviewing/considering for the role. All advertising in SEEK, Trademe and other media is client paid unless otherwise agreed.

When Teach Global formally puts a candidate forward, the Client agrees to respond within 24 hours as to whether they’d like to proceed with the candidate.  The Client agrees to interview the candidate within 4 business days, unless otherwise discussed and agreed upon with Teach Global.

Service fee: 5% fee of the starting salary or $3,000, whichever is greater, is payable to Teach Global.

  • A service fee is payable if a client does not fully provide an exclusive job listing when under an Exclusive agreement with Talk, that is, if the centre lists or fills the job with another agency, within the 3 month exclusive period. A service fee is payable if the client cancels the vacancy without reasonable cause, or does not provide reasonable explanations for decisions not to proceed with presented candidates.

  • The client agrees to promptly respond to all agency communication, acknowledging its importance throughout the recruitment process; failure to do so, resulting in the loss of suitable candidates, will incur a service fee.

  • Placement fees must be paid in full before a candidate can start the position at the client centre

5. Replacement Guarantee

Guarantee period: 12 weeks.  In the event of candidate departure within the specified guarantee period, the agency offers to promptly provide a replacement candidate at no additional cost. A refund will only be issued if a suitable replacement cannot be found.

Refund Scheme:

  • Departure within 2 weeks from start date 100% refund of placement fee*

  • Departure within 3-8 weeks from start date 50% refund of placement fee

  • Departure within 9-12 weeks from start date 25% refund of placement fee

* An admin fee of $500 applies to placements that end within 2 weeks

Refund exclusions: The client acknowledges that certain circumstances may exempt them from receiving a refund, including but not limited to instances where the candidate's departure is due to workplace bullying, harassment, inadequate training or support, misalignment with the contract or job description, or if the client breaches the terms outlined in this agreement.

5. Confidentiality

All Candidate information is confidential. Sharing or passing on a Candidate’s details to a third party resulting in an Engagement shall result in the full placement fee being payable by the Client.

6. Client Responsibilities

The Client is responsible for verifying the Candidate’s work rights, qualifications, references, and suitability.

The Agency makes every reasonable effort to ensure accuracy but does not accept liability for loss or damage arising from the Engagement.

7. Subsequent Engagement

If a Candidate introduced by the Agency is engaged within 12 months of introduction—whether directly, through another agency, or any related entity—a full placement fee will apply.

8. Liability

The Agency shall not be liable for any loss, cost, damage, or expense incurred by the Client arising from the Candidate’s Engagement, including negligence or misconduct, except to the extent required by law.

9. Termination of Agreement

Either party may terminate this agreement in writing. Termination does not affect fees due in relation to any Candidate already introduced.

10. Governing Law

These Terms shall be governed by the laws of New Zealand and Australia.

11. Amendments

These Terms may be ammeded by Teach Global at any time, without notice.
